Rebecca Girard advised that a decision hadn’t been made in relation to who would be the negotiator and this could be discussed at the next meeting.

Campaigning and actions across our union Membership figures for the branch as at 30 April 2017 is 12,004. We have continued to maintain our membership and achieve a small amount of growth. We have employed three new metro organisers in March. This team supported by their Lead Zach Walsh have been performing very well. The following table are the numbers for resignations since 20 March, when the team first started making calls. You can see that of the 228 resignation calls 50 members have been saved.

The team has helped with calls to members at NRG and Kogan Creek to update details prior to the protected action ballots. The team also made roughly a thousand phone calls each for Labour Day and picked up a lot of the calls that had been allocated to staff but who were unable to make calls due to legitimate reasons. They have planned calls for House With No Steps, Western Downs Council, Moreton and potential visits to BCC. The stats for dishonour calls or cycle lists are unknown as yet but the numbers are looking very good. To give you an idea, on cycle list 10 there were 57 members to begin with but we have been able to reinstate 47 of these with 10 outstanding to go to either peak or write off.

Executive President’s Report All areas of the Union have participated in implementing the campaigns and activities in the past 3 months and have set plans for the next three months on our key campaigns:
Making our Claims – Bargaining in Local Government and BCC in 2017;
Investing in Quality Community Services;
Making the NDIS the best it can be;
Our Energy Footprint, past, present, future.
I am happy to provide further updates at the executive meeting, if this has not been covered in your IDC meetings. For the purposes of this report there are two key outcomes I would like to report on to the executive regarding successful delegate participation. They are our delegate placement of Rosemary Larkin which occurred in March. And our delegation of community and disability workers to Canberra at the end of March.
Delegate Placement Rosemary Larkin carried out her 3-week delegate placement in March. Her primary work in this short time was to access womens refuge sites which is very difficult for our organisers to attend as they are not known to the public and hard to access even when we propose to send a female organiser on site or to a staff meeting. Rosemary has had the immediate benefit of working from the sector and the barriers organisers face were not a challenge for Rosemary. Rosemary managed to see 123 workers, had 80 workers fill out our portable long service leave survey and signed up 11 new members to the union. This is a wonderful outcome in less than 3 weeks. We are uploading all the data and mapping into our membership system to carry out the follow up of calls to new members and non-members. I have carried out an evaluation meeting with Rosemary. Our findings included: The placement was a success; For the future 2 weeks is necessary for visits plus a week to book them in before taking the 2 weeks on the road; Employees did not connect with the union at refuge about joining if in trouble as they could speak to their manager about that but seen the biggest benefit in joining was about the investment the union has into the sustainability of refuges and the community sector which they didn’t understand; they also didn’t realise the price of membership was affordable and tax deductible; May 2017

Executive President’s Report Follow up was not necessary face to face as this would be too labour intensive for Rosemary 1 day a week which we were considering. The follow up will be via the Retention & Growth team; We would look at carrying out a second round of visits potentially in October via Rosemary if she can access time off work and further assessment should be made about follow up in 2018 via another delegate.
Canberra Delegation We attended Canberra for 3 days at the end of March to lobby over 50 MPs about supporting the vital work of ASU members in community and disability services. Our Qld delegates who participated included: Dell Brookes, House with no Step Kerriann Dear, QWWS James Farrell, CLCQ Sian Tooker, Children by Choice Attached to this report is a document that discusses the parliamentary briefing which identifies what we lobbying on.
During our trip to Canberra we also had the opportunity to hold a national DV around table with the federal ALP key shadow ministers to pursue 10 days paid DFVL as part of our ‘we won’t wait campaign’. This was a great meeting but unfortunately we failed on an outcome at this meeting. We will continue to pursue this agenda at all levels of government to ensure DFVL is a universal entitlement.

In Queensland, we jointly carried out DV training for delegates with the QNU in March. These sessions were oversubscribed and we carried out a further two sessions. We have a DV around table scheduled in Brisbane for 31 May with frontline service workers and Qld Ministers. We are awaiting a date for our Townsville DV Around table.

TANA REPORT
Airlines Jetstar - Preparation for negotiations has commenced and a survey has been distributed to members and those eligible to be members. Our delegate Adam Thompson will follow this up to ensure a good response rate. the survey closes on 10 May 2017 and the results will be collated then. Qantas - A Qantas and Subsidiaries National Delegates Meeting is being held in Melbourne - 20 & 21 June 2017. Delegates from Qantas and from Jetstar will be attending. Aerocare –The Aerocare agreement is currently before the Fair Work Commission. Our union has concerns with the Agreement and does not believe it passes the Better Off Overall Test (the BOOT test). Areas of concern include the removal of some overtime payments, split shifts, and the exclusion of casual employees from the Agreement. We cannot support substandard work conditions and we await the decision of the Commission.
Armaguard - Preparation for bargaining has commenced, with a first meeting with management on 15 May 2017. A log of claims derived from our member survey will be provided at the first meeting.
Law Firms Maurice Blackburn – a new Agreement was finalised in February 2017 and a Consultative committee has been established. Slater & Gordon – meetings for a new Agreement have commenced. At this stage the employer log of claims is non specific and we are pressing for details. Both law firms have very good membership potential which we will pursue.

Aerocare agreement must comply with the law The Aerocare agreement for some staff is now at the Fair Work Commission for approval. The Commission has to make sure the agreement complies with the Fair Work Act before the agreement can take effect. Most importantly the Commission makes sure it passes the better off overall test, and to do this the Commission does its own analysis as well as asking the employer and the ASU if they think the agreement passes the better off overall test, and if not why not. The ASU has told the Commission, that, we believe the Agreement does not pass the better off overall test. What is the better off overall test? The Commission administers the better off overall test (commonly just called the BOOT) which, in the Commission’s words requires: Before approving an enterprise agreement, the Commission must ensure the agreement passes the better off overall test. This test requires that each of the employees to be covered by the agreement is better off overall than under the relevant modern award. The better off overall test is outlined in s.193 of the Fair Work Act 2009. The Modern Award for your industry, the Airline Industry, is the Airline Operations Ground Staff Award. This is a set of minimum conditions payable to employees in this industry. Other companies including Qantas, Virgin, Menzies and Dnata also have agreements which the Commission tests against this Award.
So why does the ASU think the agreement does not pass the BOOT?
not pass the BOOT. The ASU stress tested the proposed agreement line by line, against the Award and identified over thirty terms and conditions that were below the Award. From the failure to include the Award’s nightsoil allowance to the removal of overtime payments for nominated hours and shift swaps to the exclusion of nearly all shift penalties (the pre-dawn shift allowance just does not really cut it), to requiring employees to work split shifts the ASU believes our members will in fact be much worse off under the proposed agreement than the Award.
Is there anything else? Yes there is. In particular, we ask, whether it is correct that casuals have been left to languish under the Aerocare 2012 agreement? Before approving the Agreement the Commission is also required to consider what the position of casuals is. So the ASU is asking the Commission to decide if it is fair to exclude casuals who have always been included in previous agreements and decision making.

What happens now? The Commission will ask the ASU to give reasons why the ASU thinks the Commission approving the Agreement is not right. The ASU will tell the Commission that the Agreement needs to be improved, that the Agreement needs to be a better deal for our members, a better deal for Aerocare employees. The ASU wants the best Agreement possible, not an agreement that does not meet the legal test that every other company making an agreement has to abide by. We know the company objects to your union raising these concerns. This is not surprising as it means they might have to pay money to staff or change practices. They may have to include more staff in decision making.

How long will this take? It can take 8-12 weeks for the Fair Work Commission to do their analysis of the agreement and it can also take some time for the commission to have hearings. That said, it is important to remember that this process does not stop Aerocare paying the pay rise right now – it is up to them. We will keep you posted on time frames.

Meeting 3 – Slaters propose abandoning Lawyers’ quartile system! Your National Negotiating Team (NNT) met the company on 19th April 2017 and got their first responses to our claims for the new Support Staff and Lawyers agreements at Slaters. Needless to say we have not been overwhelmed with positive responses and as always there is work to do. We asked the company reps for their claims and unfortunately didn’t get anything in writing about the specifics. One of the major issues they highlighted comes from the Lawyers agreement – the company wants to abandon an important part of the quartile system i.e. the requirement to have a set percentage of employees in each quartile. This claim is a total undermining of the deal negotiated last time which took almost 2 years to finalise. It is not clear what other changes the company wants – these have been described as “administrative” but without detail it is hard to tell.
