What You Need Before You Start Filing Online Filing for a simple divorce online (or preparing your documents online before filing) can save time, reduce stress, and help you stay organized. But it’s not something you want to start casually. The smoother your filing is, the fewer delays you’re likely to face. Before you complete any forms or upload anything, you’ll want to make sure you meet Ontario’s basic divorce requirements and have your key information ready. Separation Requirements (One-Year Separation Is Most Common) In Ontario, most divorces are granted based on living separate and apart for at least one year. That separation period does not always mean you need two different addresses. Some couples separate while living in the same home due to finances or parenting. What matters is that you are no longer living together as spouses in a marriage relationship. In general, you’ll want to confirm that:
your separation date is clear and consistent you have been separated for at least one full year before the divorce can be finalized there is no chance the court will see your relationship as continuing
Also keep in mind that short attempts to reconcile can sometimes happen. In many situations, brief reconciliation efforts do not automatically “restart” the separation clock, but details matter. If you’re unsure, it’s worth getting legal advice before you file.
Key Documents Typically Needed The biggest mistakes people make are not legal mistakes — they’re paperwork mistakes. Missing one document can cause your application to be returned or delayed. Here’s what you normally need before you start: Marriage Certificate (Proof of Marriage) You will generally need a marriage certificate to apply for divorce. This proves the marriage existed legally. If you were married in Ontario, you may need to request an official copy if you don’t have it. If you were married outside Ontario or outside Canada, you will need your official marriage document from that location. If the marriage certificate is not in English or French, you may need a certified translation. Address Information for Service Even when the divorce is uncontested, the other spouse must usually be served with the divorce papers unless the process allows for an alternative accepted method. You’ll want:
your spouse’s current home address (or a reliable address where they can be reached) a mailing address if that’s different any helpful contact information for follow-up
If you genuinely do not know where your spouse is, the process becomes more complex and may require extra court steps.
Separation Date Your separation date is one of the most important details in your application. You should know the day, month, and year. This date matters because it affects:
when you can get divorced what you put in the court forms whether the timeline makes sense to the judge reviewing your file
If you and your spouse remember different dates, that’s a potential issue. It doesn’t always stop a simple divorce, but it can lead to confusion or delays. Basic Checklist for Readiness Before filing, you should be able to confidently say “yes” to each of the following: No Unresolved Disputes Being Included in the Divorce Case A simple divorce is not meant to settle everything. It’s meant to end the marriage legally. This option works best when:
you are not asking the court to decide parenting issues you are not asking the court to decide child support or spousal support you are not asking the court to divide property or debts
If there are serious disagreements on those topics, you may need a different legal process, and a simple divorce may not be appropriate. That said, many couples handle parenting, support, or property issues separately through agreements. The divorce itself can still be simple as
long as there is no request for the court to make decisions on those disputes. Ability to Complete Forms Accurately Even if your situation is straightforward, court documents still need to be accurate. The court will not “fix it for you.” Before you begin filing online, make sure you can:
read and follow instructions carefully enter names exactly as they appear on your marriage certificate double-check dates, addresses, and spelling upload the correct documents in the proper format (if required) understand what you are signing
Ontario divorce paperwork may look simple, but small errors can cause big delays. 7) Step-by-Step Online Guidance Resources When you’re filing a simple divorce in Ontario, the process can look easy at first — until you actually start working through the steps. Many delays happen because people miss one small requirement, such as a signature, a supporting document, or proof of service. That’s why step-by-step guidance resources matter. They don’t just explain the process. They help you avoid common filing mistakes and complete each stage in the correct order. A) Self-Help Guides and Checklists Self-help resources are designed for people who want clear instructions without legal jargon. A good guide will walk you through the divorce process like a checklist, making it easier to confirm you haven’t missed anything important.
Simple Divorce Step-by-Step Instructions The strongest online self-help guides usually explain the full process in a logical sequence, such as:
Confirming you qualify for a simple divorce Understanding the one-year separation requirement Preparing the required forms and documents Filing the application and paying the filing fees Serving the other spouse properly Submitting proof that service was completed Waiting for court review and final approval Receiving your divorce order and divorce certificate (if needed)
These resources can also explain practical issues that confuse people, such as:
whether you can file without a lawyer what “service” actually means how long the process usually takes what the court expects to see in a complete application
In Ontario, a major benefit of self-help guides is that they help you understand that divorce is not just “fill in the forms and submit.” The court process has specific steps, and the court won’t move forward until each one is properly completed. Common Mistakes These Guides Help Prevent A well-written checklist can help prevent errors that lead to delays, rejected documents, or extra filing work. 1) Incomplete Forms This is one of the most common issues in simple divorce filings. People often:
leave blanks without realizing they must be completed answer questions incorrectly because they misunderstand what is being asked skip sections that do not apply but fail to mark them properly forget to include details such as full names, dates, or addresses
Some online guides also provide examples of what the court is looking for, which helps people avoid vague or unclear answers. 2) Missing Signatures Missing signatures are surprisingly easy to overlook — especially when you’re printing, scanning, or uploading forms. Self-help checklists often remind you to confirm:
all required signatures are included the correct person signed the correct form the signature matches the name on the documents the form is dated properly
Even one missing signature can result in the court returning your package, which creates delays and frustration. 3) Incorrect Service Service rules in Ontario can be confusing because you generally cannot serve your spouse yourself, and there are specific rules about how service must happen. Guides help people avoid mistakes like:
serving documents in a way that is not allowed using someone under 18 to serve documents failing to provide the required proof of service not understanding the difference between regular service and special service
using an email or informal method that the court may not accept
A checklist helps you confirm service is done properly before moving on to the next stage. Why this matters: if service is incorrect, the court may not process your divorce until the issue is fixed, even if everything else is completed correctly. B) Family Law Information Centres (FLIC) Resources If you want support without immediately hiring a lawyer, Family Law Information Centres (FLIC) can be one of the most helpful starting points in Ontario. FLIC exists to help people understand the family court process, including divorce-related forms and steps. What FLIC Is and What It Offers A Family Law Information Centre (FLIC) is a service available at many Ontario family courthouses. It helps people who do not have a lawyer (or who are just beginning the process) by offering basic guidance and information. FLIC can be useful because they help you understand:
what forms apply to your situation how the family court process works in general what you need to file and when what to expect after filing
Even if you are doing a simple divorce, FLIC can help reduce confusion, especially around procedural steps like filing and service.
How to Access Help (In-Person or Guidance Tools) FLIC services are often available in person at family courthouses, and in some locations, you may find additional supports such as printed materials, public information sessions, or referrals to other services. Depending on the courthouse, access may include:
speaking with court staff who provide general procedural information asking questions about where to locate and file forms using self-help materials or court-approved guidance getting information about Legal Aid services or other community supports
In some cases, there may also be duty counsel services available for eligible people, although availability and eligibility vary. If you want to avoid wasting time, it helps to arrive prepared with:
your separation date your marriage certificate (or details about it) your spouse’s address a list of your questions notes on what you’ve already completed
This makes it easier to get clear guidance without going in circles. What They Can and Cannot Do It’s important to understand what FLIC can do, because many people assume it works like free legal representation — and it does not. What FLIC can do:
explain court procedures in plain language help you understand what steps come next
provide general information about divorce and family court direct you to forms and resource materials tell you where and how to file documents help you understand what documents the court typically expects
What FLIC cannot do:
give legal advice tailored to your situation tell you what outcome you will get in court negotiate with your spouse on your behalf act as your lawyer complete your divorce filing for you represent you in court
Think of FLIC as a place to get process guidance, not legal strategy. If your divorce stops being “simple” (for example, if parenting disputes, child support issues, or property disagreements appear), that’s usually a sign you should get legal advice before moving forward. C) Legal Aid Ontario (Online Info) Even when a divorce is “simple” on paper, people can still feel overwhelmed by the process. That’s where Legal Aid Ontario (LAO) can be helpful. Their online resources are especially useful for people who need clear information, may not be able to afford a lawyer, or want to understand their options before filing. Legal Aid Ontario does not help every person in every situation, but it is one of the most important official support options available in Ontario family law. Who May Qualify Legal Aid Ontario is generally intended for people who meet certain eligibility requirements. While eligibility can vary depending on your situation, LAO often considers factors such as:
Income level (financial eligibility) Family size and household situation Whether your legal issue involves family law matters such as: o parenting arrangements o child support o spousal support o family violence concerns o urgent or high-risk situations
If your divorce is truly “simple” (no claims for parenting, support, or property division), you may not qualify for full legal representation. However, you may still be able to access helpful information and guidance online. Important note: Many people assume “simple divorce” means “no legal risk.” That is not always true. If you are unsure whether you qualify or what help is available, checking LAO resources can at least help you understand the next step. What Support Is Available Online Legal Aid Ontario provides online tools and information that can help you understand the divorce process and avoid costly mistakes. Even if you do not qualify for a legal aid certificate, online resources may help with:
General information about separation and divorce in Ontario Understanding basic family law terms and court steps Learning what forms and documents may be required Finding out what to expect during the court process Accessing referrals to community legal clinics (where available) Locating additional legal resources and support services
For many people, these resources are useful at the planning stage — before you file anything. They can help you avoid confusion, reduce
panic, and confirm whether your situation is truly appropriate for a simple divorce application.
When to Seek Legal Help Even for “Simple” Divorces A simple divorce is meant to be straightforward, but it can become complicated quickly if certain issues exist in the background. In many cases, people only realize this after they file — and by then, it can create delays or legal problems. You should strongly consider seeking legal advice (even if it’s limited advice) if any of the following apply:
Children are involved, even if you and your spouse “agree” o Parenting and child support issues often need careful handling, and the court may still require proper information. There is a history of family violence, intimidation, or controlling behaviour o Safety and power imbalance can affect your ability to negotiate fairly or even complete service safely. You are unsure about child support or spousal support o Even if you aren’t asking the court to decide support, support rights can still exist. There are shared assets or debts, including: o the matrimonial home o joint bank accounts o lines of credit o pensions o business ownership o significant personal debt You think your spouse may not cooperate with service o If your spouse is hard to locate or refuses to accept documents, the process may require extra legal steps. Your spouse lives outside Ontario or outside Canada
Service rules and timing can be more complex. You don’t fully understand what you are giving up by “keeping it simple” o A divorce ends the marriage, but it does not automatically settle property or support issues unless those are handled properly elsewhere. o
A good way to think about it is this: A simple divorce is only simple when your situation is simple. If anything feels unclear or high-stakes, getting legal guidance early can protect you from filing something that later becomes difficult (or expensive) to fix. Common Online Filing Mistakes (And How to Avoid Them) Filing a simple divorce in Ontario can feel manageable when you’re using online resources, but the process still runs through the court system — and the court expects everything to be complete, clear, and properly filed. Many divorce delays are caused by small online filing mistakes that seem minor at the time but create problems later. The goal is not just to submit your documents, but to submit them correctly the first time. Below are the most common mistakes people make when filing online and how to avoid them. Using Incorrect or Outdated Forms One of the biggest risks when filing online is downloading the wrong form from an unofficial source or using an old version that the court no longer accepts. Why it causes problems:
The court may reject your application package
Required sections may be different You may miss updated instructions or signature requirements
How to avoid it:
Always use forms from official Ontario court sources Double-check the form number and title before filling it out Avoid random “free templates” or third-party sites that may not match Ontario’s requirements Re-download your forms if you took a break from your divorce process for weeks or months
Even one outdated form can stop the entire application from moving forward.
Forgetting Required Attachments Many applicants focus heavily on completing the forms but forget to include the documents the court expects to see attached. Why it causes problems:
Your application may be returned as incomplete You may have to re-file or submit extra documents later Your divorce can be delayed for weeks due to missing paperwork
Common attachments people miss:
Marriage certificate (or the correct proof of marriage) Any required supporting documents related to service Any additional sheets referenced in the form (for example, extra details pages)
How to avoid it:
Use a checklist before you submit anything
Confirm you have attached the correct document to the correct form Name your files clearly so you don’t upload the wrong thing (example: “MarriageCertificate.pdf”) Keep everything in one folder so nothing gets lost
If you’re unsure what attachments apply to your filing, it’s better to confirm early than to submit incomplete documents. Mistakes in the Separation Date Your separation date is not a “small detail.” It affects the timeline, the legal basis for divorce, and whether your application makes sense when reviewed. Common separation date mistakes:
guessing instead of confirming the date mixing up the separation date with the date you moved out choosing different separation dates on different forms selecting a date that conflicts with other facts in the application
Why it causes problems:
The court may question the timeline You may accidentally file too early Errors can result in delays or requests for clarification
How to avoid it:
Decide on one separation date and use it consistently everywhere Use a written timeline (marriage date, separation date, key events) If the separation period is close to one year, do not rush — even a small timing mistake can cause a rejection
If you and your spouse dispute the separation date, consider legal advice before filing.
Not Understanding Service Rules Service is one of the most confusing parts of divorce filing, especially for people who are doing everything online. Even with a simple divorce, you generally must serve the divorce application on your spouse using the proper method, and then provide the court with proof that it was done correctly. Common service mistakes include:
serving the documents yourself when you’re not allowed to choosing the wrong type of service failing to provide proof of service using informal service methods (text message, email, or dropping documents off) without proper approval using someone who is not eligible to serve documents (for example, under 18)
Why it causes problems:
If service is invalid, the court may not proceed Your divorce may be delayed until service is corrected You may have to serve everything again
How to avoid it:
Read Ontario’s service instructions carefully before you start Use a reliable adult to serve documents, or a professional process server if needed Keep records and complete the correct proof of service paperwork Don’t assume your spouse “knows about it” is good enough — courts need proper documentation
If your spouse is hard to locate or refuses to cooperate, service becomes more complex and legal advice may be necessary.
Missing Fee Payments or Paying Incorrectly Court filing fees are part of the process in Ontario, and issues with payment can delay your application immediately. Common payment mistakes:
submitting forms without paying the required fee paying the wrong amount paying for the wrong type of filing step not keeping proof of payment assuming fees are optional because the filing is online
How to avoid it:
Confirm the current court filing fees before submission Pay using approved methods and keep your receipt or confirmation Save proof of payment in the same folder as your divorce paperwork If you are applying for a fee waiver, make sure you complete that process properly before relying on it
Even a perfect application can be delayed if the fee is missing or processed incorrectly. Submitting Unclear Scanned Documents Online filing often requires scanning and uploading forms, and this is where many people run into trouble. Even if your forms are correct, poor-quality scans can slow down processing or cause your documents to be rejected. Common scanning issues:
blurry text that cannot be read missing pages
documents scanned sideways or upside down signatures cut off at the bottom of the page dark shadows from phone scanning low-resolution photos instead of clear scans
Why it causes problems:
Court staff must be able to read every part of the form Unclear documents may be returned for correction The court may treat the submission as incomplete
How to avoid it:
Use a scanner when possible (not just a quick phone photo) Review every page before uploading Make sure signatures and dates are clear Save files as PDF whenever possible Use simple filenames and avoid uploading multiple versions of the same form
A good rule: if you have to zoom in and squint, the court will struggle too. Choosing Between DIY Online Filing vs Lawyer Support When you’re filing a simple divorce in Ontario, one of the biggest decisions is whether you should handle the process yourself using online resources, or get help from a lawyer (or a legal service) to complete and file everything correctly. There is no single “right” option for everyone. The best choice depends on how straightforward your situation is, how comfortable you feel with forms and deadlines, and how important it is for you to avoid delays caused by paperwork errors. Below is a clear comparison to help you decide.
DIY Online Filing: Best for Straightforward Cases With No Disputes DIY filing is often the most affordable route. It can work well when your divorce is truly simple and you are able to follow instructions carefully. DIY filing is usually best if:
you and your spouse agree the marriage should end there are no disputes about parenting, child support, spousal support, or property division you have your marriage certificate available you know your separation date clearly you have a valid address for your spouse for service you are comfortable downloading forms, completing them carefully, and checking details
Benefits of DIY online filing:
lower cost than hiring a lawyer you control the pace and timeline you can use official self-help guides and checklists to stay organized it may feel simpler if your case is very basic
Common challenges with DIY filing:
higher risk of small mistakes (missing signatures, wrong forms, unclear scans) service rules can be confusing you may not realize your divorce is not “simple” until you’re already in the process stress and uncertainty if you don’t know what the court expects
DIY works best when you are patient, detail-oriented, and able to stay consistent with paperwork. Lawyer Support: Best When You Want Fewer Errors and Faster Approval Even a simple divorce can be delayed if something is missing or filed incorrectly. Lawyer support is often chosen by people who want the process done properly the first time, without spending hours researching every step. Lawyer support is usually best if:
you want a smoother process with fewer errors you’re worried about missing steps or filing the wrong documents your spouse is difficult to contact or may not cooperate with service you have children and want to ensure the court sees correct information you’re unsure whether support or property issues could still matter later you want peace of mind before signing court documents
Benefits of lawyer support:
fewer mistakes and less back-and-forth with the court clearer guidance on service requirements better organization of documents and attachments you can avoid unnecessary delays caused by technical filing errors you get answers when something doesn’t seem clear
The biggest value of legal help in a simple divorce is prevention. A lawyer can help prevent the kinds of small mistakes that lead to big delays. Virtual Divorce Services
Virtual divorce services have become more common in Ontario. These are typically services that help you complete your divorce remotely, often without needing in-person meetings. Some are run by law firms, while others are document preparation services. Because quality varies, it’s important to understand exactly what is being offered before you pay. What Virtual Divorce Services Typically Include Depending on the provider, virtual divorce services may include:
a short intake form where you provide your details preparation of the required divorce application forms review of your documents for accuracy and completeness instructions for signing, scanning, and filing guidance on service steps and proof of service ongoing email support for questions filing support (sometimes they file for you, sometimes you file yourself) updates on what happens next and what timelines to expect
Some services are limited to simple divorce paperwork only. Others offer optional upgrades, such as legal advice, court representation, or help with related agreements. A good virtual service should not make the process confusing. It should make it easier, clearer, and more reliable. What Questions to Ask Before Hiring Before choosing a virtual divorce service in Ontario, ask the questions that protect you from paying for something that doesn’t actually help. Key questions to ask:
1. Is this service provided by a licensed Ontario lawyer or law firm? This matters because only a lawyer can provide legal advice. 2. What is included in the flat fee — and what costs extra? Ask if the price includes form preparation, filing guidance, and revisions if mistakes are found. 3. Do you help with filing and service, or do I do that myself? Many services prepare documents, but you must still complete service properly. 4. Will you review my marriage certificate and ensure the documents match it exactly? Spelling mistakes and incorrect names can cause serious delays. 5. How do you handle proof of service requirements? This is one of the most common issues that causes online filing delays. 6. What happens if the court rejects the documents or asks for corrections? Ask whether corrections are included or charged separately. 7. How long does the process usually take once I provide my information? Be cautious of unrealistic “instant divorce” claims. 8. Will I have access to help if I have questions during the process? Some services provide support only at the beginning. 9. Will you confirm that my situation qualifies as a simple divorce before starting? This matters because if your case involves parenting, support, or property issues, you may need a different approach. 10. Do you provide receipts, written agreements, and clear terms of service? Professional providers should be transparent.
