1. General Information The Asia/Pacific Cultural Centre for UNESCO (ACCU), and Indonesian Book Publishers Association (IKAPI) will co-organize the National Seminar and Workshop for Copyright Awareness and the Production and Utilisation of the Indonesian Version of “Asian Copyright Handbook” from 23 to 26 January 2006, in Jakarta in cooperation with the Ministry of Law and Human Rights of the Republic of Indonesia, Ministry of National Education of the Republic of Indonesia, Indonesian National Commission for UNESCO, UNESCO and Japan Copyright Office (JCO) of the Agency for Cultural Affairs.

People and government have long recognised the importance of creativity to economic development. Governments also began systematically protecting the rights of creators and inventors through copyright and patent laws. Even in countries where such laws are already in place, they sometimes need to be updated or amended to take into account new development both in the scientific world and in the international sphere. In Indonesia, the Indonesian copyright law was amended in 1987, 1997 and finally in 2002, bringing it largely into conformity with modern international standards, and it now needs to be disseminated and promoted to enhance copyright awareness in Indonesia.

1. Background Books are above all works of the mind, creativity and culture of people living everywhere, contributing to the enrichment of intangible heritage and intellectual properties in the region. Copyright, which protects rights of authors, illustrators and other creators by providing a legal framework, plays a crucial role in promoting their activities. It is considered that, in many countries in Asia, the importance of protecting copyright and providing basic knowledge about its functions is not fully recognized, and the interpretation of what copyright means varies greatly from country to country. There are still many countries which do not have sufficient copyright legislation to work effectively with foreign countries within the framework of international standards.

However, law enforcement with regard to cases of copyright infringements has been hesitant at best. Law enforcement apparatuses have been quite reluctant to take measures although infringements and piracies have been perpetrated relatively openly. People in Indonesia are familiar with the principle of honouring the works of other persons who have worked hard to create them. Mutual respect and recognition as regards the works of others would facilitate the acceptance of the copyright of others. Despite this, however, infringements have been going on unabated. Why? Have there been changes? Education plays an important role in the socialization of copyright in Indonesia, along with law enforcement, which is a part of the educational process itself.

ACCU, since its inception in 1971, has been promoting awareness building on copyright among publishers and creators in Asia and the Pacific through training programmes and by providing the latest information through magazines and websites. Under these circumstances, ACCU and JCO produced a handbook titled “Asian Copyright Handbook” in English in 2004 for those engaged in book production such as writers, illustrators, editors and publishers in Asia, to disseminate basic information about copyright. Furthermore, a series of workshops is also planned in several Asian countries to produce vernacular versions of the handbook and to plan a scheme for their dissemination and utilization.

2. Objectives In order to promote better understanding of the concept of copyright through lectures and the handbook among the people engaged in publishing activities as well as in related fields in Indonesia, the seminar/workshop aims: 1) To promote copyright awareness to all concerned in Indonesia 2) To share information about the current situation and problems regarding copyright protection in Indonesia; 3) To share information about the current situation and problems regarding copyright protection in countries in Asia; 4) To introduce and promote better understanding of the handbook by reviewing a draft Indonesian version and to identify points and sections where more explanation would be necessary for the handbook to be useful in Indonesia;

The rapid advance of technology, particularly in the field of information and communication has made intellectual property rights more and more important. Further, intellectual property rights have become inextricably linked to human interactions and the relation between nations.

To draft an additional explanation for the points and sections identified above, which will be appended as a supplement to the Indonesian version of the handbook, To develop an action plan, including an activity schedule and responsible organizations, for compilation, publication, distribution and utilization of the handbook in Indonesia; and To develop action plans for promotion of copyright awareness programmes in Indonesia.

Financial Arrangements (1) Travel: • IKAPI will bear travel expenses for participants and resource persons from Jakarta according to its regulations. • ACCU will bear travel expenses for resource persons and observers from abroad and participants from outside Jakarta. (2) Board and Lodging • ACCU will bear costs of board and lodging including room charges, meals and other miscellaneous costs for resource persons from abroad. • ACCU will bear costs for room charges for participants outside Jakarta and official observers.

4. Keynote Speech Keynote Speech by Mr. Hamid Awaludin, Minister of Law and Human Rights

The problems that have come up lately have as its source the weakness of copyright protection for copyright owners, including book writers. Indonesia has been included on the list priority watch of The United States Trade Representative (USTR) since 2001 on account of the high rate of copyright infringements in the country. The lack of awareness of the need to respect the works of others by the members of the society, and the rapid proliferation of gadgets for multiplication of cultural work, did indeed give the impression of the opening of ample rooms for acts of copyright infringements. The purchasing power of most Indonesians being modest, they prefer pirated books, although the quality is poor, since their prices are low. The prices are low because the pirates do not have to pay royalty to the writers, no taxes, nor pay for promotion and distribution. They use poor quality paper. Piracy has brought losses to the society as a whole, in particular in access to books for enhancing the quality of human resources, for publishers become hesitant to produce books in a sustainable way, postpone book production or reprinting of best sellers because of being competed out of the business by pirated books, and this in turn weakens the work spirit of authors. Piracy brings impacts on other nations in the international scene. Disputes between nations on the issue of intellectual property are no longer confined to technical matters pertaining to law, but has become trade disputes. If no measures are taken to remedy the situation, trade disputes could elevate to political conflicts between nations.

The theme of the seminar has something to do with the enhancement of awareness and comprehension of the importance of copyright protection of cultural works, in particular of books. This issue has become an important issue, especially in connection with the importance of books for enhancing human resources and the role of the protection of copyright in book publishing industry, which in turn correlates with national economic development. Copyright law is expected to enhance the appreciation for human dignity, in particular in the creation of cultural works, such as books. The essence of copyright protection lies in the protection of economic rights of authors. Book authors will benefit from economic gains for having worked hard to produce a book. On the other hand, those who would like to enjoy the work should show their appreciation to the author by asking for his permission, or for a license, for the use of his work.

The government of Indonesia has taken several steps in this direction within the last few years. A number of measures have been taken to deal with issues pertaining to copyright and its protection. 1. Enhancement of copyright awareness in regions undertaken regularly every year, in cooperation with domestic and foreign institutions, attended by various stakeholders, such as small and medium-sized industries, artists, academicians, law enforcers, professional associations, and others having interest in copyright.

Indonesia has had a long history of copyright, beginning with the 1912 Auterswet (Law of Writers) issued by the Dutch colonial government. Then, in 1982 the 1982 Copyright Law was launched. Revision was carried out later, resulting in the issuance of Law No. 12/1987. Another revision brought forth Law No. 12/1997, which accommodated some stipulations of TRIPs. In 2002, Law No. 19/2002 on Copyrights was agreed upon, replacing all prior copyright laws. With this law, Indonesia has carried out fully its obligations in terms of legislation for accommodating the stipulations of TRIPs, Berne Convention, WCT and WPPT. The revision of copyright law was aimed not only to accommodate international agreement stipulations but also to stimulate local potentials for the production of cultural works, given the cultural diversity of Indonesia.

2. Training in copyright, within the country and abroad (such as Japan, Europe, and USA) for civil servants serving at the Directorate General of Intellectual Property, civil servants at the regional offices of the Department of Law and Human Rights, members of the National Police Force, the office of the Attorney General, judges, customs officers, Department of Trade, universities, the press, and other related governmental agencies.

ANNEX backgrounds cope with issues of copyright protection, for we know cultural factors could often hinder efforts at copyright enforcement. It might be that studies need to be carried out on cultural systems that obtain among the ethnic groups of Indonesia and the issue of their alignment with the values pursued by copyright law. This relates to the effort to enhance awareness and compliance with law, towards the achievement of the supremacy of law in Indonesia.

2. Enhancement of awareness of the importance of intellectual property protection through education, by inclusion of intellectual property in the school curriculum, from that of the elementary school to that of universities. 4. The Directorate General of Intellectual Property has formed coordinating task force to deal with copyright infringements based on the Ministerial Decision No. H.72.PR.09.02 of 2003, which will be replaced with a stronger authorisation, namely the presidential decree.

In conclusion, I would like to thank the speakers, the moderators and the participants of the seminar, who I believe will diligently follow the whole program to the end.

5. The Directorate General of Intellectual Property has carried out dissemination of information and enforcement activities regularly and in stages, in all regions of Indonesia. On the basis of the Circulation Letter of the Intellectual Property Director General No. H.UM.06.02.02/2004, all bureau head of the regional office of the Department of Law and Human Rights have conducted enforcement exercises all over Indonesia, such as issuing warning letter to all owners of shopping malls not to provide facilities for the sale of pirated goods, including books.

Reciting “In the Name of Allah, the Most Gracious, the Most Merciful,” I hereby declare this seminar and workshop officially opened. Thank you.

The proliferation of piracy recently calls for strong and effective enforcement of copyright law, including remedies for dispute resolutions, undertaken without much delay. The 2002 Law No. 19 on Copyrights contains a number of new stipulations pertaining to the enforcement of copyright: a. The establishment of special courts to handle copyright cases, i.e. Commercial courts. b. Rapid handling of cases by the commercial courts, i.e. no longer than 90 days. c. Injunctions to prevent further losses on the part of copyright owners. d. Minimum one month imprisonment and/or fine to the tune of five billion rupiah. e. Rules on right of electronic management information and mechanism for technological control. f. Rules on indication of control mechanism and protection for products using high technology production infrastructure. The Department of Law and Human Rights supports the production and utilisation of the Indonesian version of the Asian Copyright Handbook which is slated to be worked out in this seminar and workshop. It is hoped that the book would support the program of the government in the enhancement of the awareness of the people of Indonesia as regards copyright. The fact the book mentions specifically the region of Asia, it is my hope that we might find in the book something to learn about how the Asian societies with different cultural 92

With such easy access and ability to copy by anyone, anytime, the lack of respect for originality will eventually dampen creators’ enthusiasm to make new creations and to contribute to developing culture. Today, it is not only for the selected experts, but also the general public that the education of copyright is necessary.

ACCU, since its inception in 1971, has been promoting copyright to publishers, writers, and other personnel concerned in the field of book development in Asia and the Pacific countries through our programmes and provision of information. To disseminate basic knowledge about copyright widely to the public, ACCU and the Japan Copyright Office, produced a book entitled “Asian Copyright Handbook” in 2004, which expounds the universal philosophy of copyright. With support from Japan Copyright Office, a series of workshops in several Asian countries was planned. One of its aims is to produce vernacular versions of the Handbook to suit the local needs and to make a framework for their dissemination and utilization, and also to foster copyright awareness. I am happy to announce that two previous workshops were successfully conducted in Viet Nam and Myanmar respectively last year and that Vietnamese and Myanmar versions of the handbook have been published as outcomes of the two workshops. I am looking forward to hearing about their follow-up activities from the representatives of the 2 countries, who have come here to share their experiences with you all.

It is a great honour and pleasure for me to welcome all of you, on behalf of Asia/Pacific Cultural Centre for UNESCO, on the occasion of the opening of the National Seminar and Workshop for Copyright Awareness and the Production and Utilisation of the Indonesian Version of “Asian Copyright Handbook”. First of all, I should like to extend my heartfelt appreciation for the great efforts made by the Indonesian Book Publishers Association in coorganising this very important initiative in Indonesia, with the strong support of the Ministry of Law and Human Rights, the Ministry of National Education and the Indonesian National Commission for UNESCO. My thanks also should go to international resource persons, Ms Morgan from Australia, Ms. Dairaku from Japan, Mr. Raslan from Malaysia and Ms. Totcharova from UNESCO for their forthcoming energetic and informational support to this Workshop.

I understand that Indonesia is one of the most advanced counties in Asia in regulating copyright law, and is very earnest to foster public awareness. I hope this Workshop in Jakarta will promote your efforts in disseminating the idea of copyright.

As you know, copyright is intended to protect cultural works. Copyright offers financial support and respect to creators, to assure them to concentrate on their creative activities. Copyright serves as a foundation for cultural development of all humankind today. In the interest of fostering copyright protection, it is imperative that each and every citizen have an awareness and deep understanding of copyright issues.

In the Workshop, precious inputs from resource persons will be provided to inform all the participants of the most important matters responding to the needs regarding copyright issues. Reflecting the ideas given and the other informative resources, I believe all of you gathered here will eagerly formulate comprehensive strategies to develop and utilize the Indonesian version of the Handbook, and bring out action plans to enhance copyright awareness in your country.

However, we are deeply sorry that, in spite of copyright laws and international treaties, many people, even those engaged in creative industries are still unaware of the damages infringement of copyright will bring to the development of one’s own culture. It is said that the presently so-named developed countries were countries that had put the highest priority on copyright and patents protection, through legislation systems. The effective enforcement of copyright and patent protection has enouraged the production of the best works and new inventions. I would like to welcome all of you and to thank you for your kindness in making yourselves available here in Jakarta so that together we can share views on how to enhance our awareness and that of the members of the society with regard to copyright, which will be the topic to be addressed in this national seminar and workshop in the coming few days.

It is competition among individuals and groups that have encouraged progress in all modern states. It is competition that have motivated authors and inventors, since copyright law has enabled them to make use of their creations for their own pusposes. On behalf of Indonesian book publishers and the book society in Indonesia, I would like to express my sincere gratitude to ACCU (Asia/Pacific Cultural Centre for Unesco) for having given full support for the preparations and organisation of this national seminar and workshop.

It is clear from the above that copyright protection protects not only the authors but also those who are involved in working with copyrighted materials; in short, all of the stakeholders.

Indonesian Book Publishers Association (IKAPI), with its 686 members that publish at least 10000 new titles every year, feels strongly about the issue of copyright protection and hopes that it can have as one of its activities this kind of seminar and workshop, to address the many issues we are facing pertaining to copyright protection.

From the point of view of business management, there are five main reasons I see that relate to the importance of the protection of intellectual property for business growth:

As an illustration, in its research recently in Jakarta, the task-force of book piracy found at least 20 to 30 titles were pirated. The perpetrators were groups consisting of persons with money, printers, book sellers, and members of the police force. Perpetrators could also be individuals operating alone.

First, intellectual property in developing countries like Indonesia is very important for both large and small publishers. In addition to obtaining licenses from foreign publishers, Indonesian publishers also create local materials in local dialects and local wisdom. The protection of their creations will mean not only that prevailing norms are met but also that law enforcement is being adhered to. For us publishers, enforcement functions not only as enforcement as such, but also as an important instrument for developing business ethics in the area of intellectual property.

Owing to fund limitations, the task force could only carry its task twice a year, in a very confined area. Its capacity to arrest book pirates (aided by the police) is low, only 10-15% at the most. From among those arrested, only one or two had been punished, the rest had been able to escape punishment.

ANNEX Second, local book publishers are victims of piracy, as also true for international publshers. However, for local publishers, the destructive impact thereof is larger since they operate in their own market. This fact means that develoment and protection of intellectual property must proceed in tandem.

Third, we are aware that the price of books and the purchasing power of the people are important issues; this calls on the publishers to always endeavour to produce quality books at prices the people can afford. We must always be aware and adhere to the principle that there is a correlation between the risks faced by publishers and earnings that accrue to them. If the risks are high, earnings potentials are also high. On the other hand, if the risks are low, margin are also low, because of competition from other publishers.

First of all, let us praise God the Almighty for his blessing. I would like to welcome the Director General of Asia/Pacific Cultural Centre for UNESCO and his staff and expressed my heartfelt thanks for the organization of the workshop and especially to ACCU’s contribution to have the Indonesian version of Asian Copyrights Handbook which has been produced by ACCU. I would like to welcome all of the participants of the seminar and workshop who will contribute to the final version of the translation and adaptation of the Asian Copyright Handbook in Indonesian language.

In addition, there is also a correlation between transaction volume and margin. If the volume is large, the margin will be low, but if the transaction volume is low, margin will be high. This kind of market mechanism, if it could operate well, could prevent, or at least slow down, the rate of piracy in this country.

I would like also to congratulate IKAPI which has prepared the seminar and workshop together with the Indonesian National Commission for UNESCO without which today’s activity could not be realized.

Fourth, shortage of law enforcers could weaken the motivation and creativity of those publishers who are more productive, more locally oriented and do business on local prices. To address this condition, there is a need for appropriate measures on the part of the government, libraries well-supplied with books, community development, and programs for the society at large for making books available to all.

Copyrights is a protection that covers published and non published literacy, scientific and artistic works , whatever the form of expression, provided such works are fixed in a tangible or material form. Copyright laws grant the creator the exclusive right to reproduce, distribute, perform, and display the work publicly. Exclusive means only the creator of such work not anybody who has access to it and decided to grab it.

Fifth, publishers’ behavior changes from time to time, and we must think more and more in the long term. We must be aware that books we produce are the building block for developing our potential markets in the future, since they will be more educated, more sophisticated, more productive in their works, and will have more purchasing power, that in the end we will be creating higher demand for books in the future. Hence, publishers and the society as a whole will get benefit from this condition. Needless to say, then, that publishers and the government must work hand in hand as a partner to achieve common goals in giving support to the people in their effort to become more educated, more sophisticated, more competent, and more productive.

Copyright is an important issue because it could protect the rights of those who express their creation, it could serve the economic situation to the producers and it could also serve as a foundation for cultural development in a country. In addition to this, copyright could also serve the dignity of authors, scientists, musicians and artists which could stimulate and encourage them to do more creative activities and by providing the promotion and protection of the rights, they will pursue more intellectual activities for the development of culture in their own countries. Since the idea of copyright is still not well understood by the society, it is essential to promote copyright awareness.Therefore, promoting copyright protection and awareness is a must which could only be achieved through education and training. The training especially should be provided to teachers at every level of education and perhaps

However, awareness raising to make people understand about copyright is not the only way to promote copyright protection. Supporting authors’, musicians’ and artists’ economic profit and their dignity, copyright stimulates and encourages their new creative activities. Through the good protection of the authors, the citizens of a country can enjoy their life with literature, music, art and all other forms of creation.

IKAPI which is the Indonesian Association of Publishers is expected to publish the Indonesian version of “Asian Copyright Handbook” and to spread the basic knowledge about copyrights at a wide distribution.

In the interest of fostering copyright protection, it is extremely important that every citizen has an awareness and basic understanding of copyright. It is important not only for creators of arts but also for every ordinary people.

Finally, I wish you a successful workshop and I hope to see all of you for dinner tomorrow night.

In our knowledge-based society of the 21st century, the creation and distribution of ideas will have more and more important power. At the same time the value of an idea can be easily stolen by digital technology, by world wide networks like Internet and so on. We have to continue our efforts to adjust our legislation for our rapidly changing environment. As you may be aware, Indonesia is one of the most advanced countries concerning legislation of copyright and neighboring rights. You have already joined almost all international treaties, including WCT and WPPT. However we have also many things to do.
