n deepest gratitude to The One Almighty God, The Republic of Indonesia Attorney General Office presented The 2013 Annual Report for all the people of Indonesia as the realization of commitment from The Attorney Service to inspire the principle of transparency through Transparent Public Information to guarantee the fulfilment of right of the constituent to obtain allinclusive information on law associated public policy development program and the achievement of The Attorney Service in 2013. The Republic of Indonesia Attorney General Office understands the value and necessity of the principle of transparency for the constituent to be able to actively participate in the observation over the performance of Attorney Service so as to ensure eradication on the chance for corruption, collusion and nepotism by the civil servant, and to give the opportunity to the public to provide inputs of advice and suggestion for decision making on Public Policy within Attorney Service in subsequent year, as well as ensuring a more accountable performance of The Republic of Indonesia Attorney Service. All of those were expected to deliver the final output of the establishment of Good Governance within The Attorney Service. This annual report is a document on the performance of The Attorney Service throughout 2013, which was composed from the compilation of work from many others who had contributed to the content which correlates with the developmental planning of Attorney Service within The Attorney Service 2010-2014 Strategic Planning, Attorney Service 2013 Work Plan, and the evaluations on periodical reports from all Attorney Offices throughout Indonesia. Numerous targets and achievements performed by Attorney Service in 2013 as proper to the government policy written in the National Development Plan were descripted within this annual report. The analysis on targets and achievements had become a component in the effort to synergize planning, organizational and implementation up to the phase of evaluation from every aspects, encompassing the elements of man, material and money, which was to accomplish the mapping of problems versus solution for the improvement and refinement of Attorney Service within the following year. We trust that the report would deliver aspiration and comprehension to the general public on the progressing organization of The Republic of Indonesia Attorney General Office to answer the challenges and public expectation, as well as to become a positive reference for the readers and the observators of law enforcement in Indonesia.

Mission
1. To optimize both the quantitatitve and qualitative performance of the Attorney General Office functions in performing duties and exercise of powers in aspects of the handling of criminal, civil and administrative cases, and to optimize the intelligence functions of the Attorney General Office in a professional, proportional and honorable manner through the appropriate, well-designed, focused, effective and efficient application of standard operating procedures. 2. To optimize the role of development and supervision so as to support other divisions in the performance of their duties, in particular regards to law enforcement. 3. To optimize public services in the legal field based upon full responsibility, principles, effectiveness and efficiency, and to hold the rights of the public in high regard. 4. To reform and reengineer the organizational structure of the Attorney General Office and the management of information system, particularly through the implementation of the quick-wins program so it may be easily accessed by the public, the preparation of a Blueprint for the development of Attorney General Office human resources over the mid and long terms up to 2025, the reform and reengineering of financial administrative management, improving infrastructure and facilities, and improving the welfare of staff through better remuneration to ensure a more effective, efficient, transparent, and accountable performance of the Attorney General Office. 5. To produce Attorney General Office officials whom are reliable, resilient, professional, and imbued by a high level of morals and ethics, in order to support the eloquence performance of foremost duties, function powers, particularly in regards to the effort of equitable law enforcement and other related duties.

DUTIES & POWERS Referring to Article 30 Legislation No. 16/2004 on R.I Attorney Service, the duties and powers of the Attorney General Office are as follows:

In the Public Order and Security Sector, the Attorney General Office has the following duties :
• To conduct prosecutions; • To enforce judicial orders and decisions of final and conclusive effect; • To conduct supervision of those serving conditional sentence, placed under supervision orders, or released on parole;
The prosecution service, based on special authority, may act both at home and abroad for and on behalf of the state or government.

T
o optimize the performance of law enforcement as proper to the main duties and functions of The Attorney Service as stipulated in Legislation No. 16/2004 on R.I Attorney Service which defines the action plan of R.I Attorney General Office’s mission that referred to the entirety of document on National Development Planning system, both in the Long Term National Development Planning (Rencana Pembangunan Jangka Panjang Nasional/RPJPN) 2010-2025, and in the Mid Term National Development Planning (Rencana Pembangunan Jangka Menengah/ RPJMN) 2010-2014, and Government Annual Workplan (Rencana Kerja Pemerintah/RKP), in every year Attorney Service had established a strict target on performance as well as put the best effort to accomplish the target on 2

performance as mandated. The effort to accomplish the target had double functions; first, to show the commitment of Attorney Service in giving positive constribution for achievement of the long term national development planning mission of “The Realization of an Autonomous, Progressive, Impartial and Prosperous Indonesia”, second, to demonstrate the vigor of Attorney Service in meeting the public demand to achieve trusted Attorney Service in its reform. In 2013, Attorney Service had made numerable achievements in law enforcement and internal organization as referred to bureaucratic reform program. Related to law enforcement, particularly to anti corruption as an implemented national priority, Attorney
Service had exceeded the target of 1.430 cases with accomplishment of 1.653 cases, or 115,59 % achievement. In prosecution the achievement was 141,47 %, or 2.023 cases the target of 1.430, with summative recovered public wealth of IDR 403.102.000.215 dan USD. 500.000 from the Special Crime division. These quantitative achievements could be assumed as astonishing ones considering the numbers of accomplishment which exceeding the target of budget supported outputs. Nonetheless, further improvement to leverage the quality of the achievements is still needed so as to give the aspect of public interest grand corruption to the managed cases. Attorney Service was aware of the need and will therefore, making a series of arrangement to meet the requirements as expected by the public on the justice treatment for anti corruption cases. Attorney Service divided General Crimes Division into three categories of Man and Possession, State Security and Public Order, and Other General Crime Acts. In 2013, General Crimes recorded 111.472 cases under all of the categories from all over Indonesia, which had 98,8% rate success of the case disposal or equal to 110.194. During the same year, by means of conducting civil court, the division of Civil and State Administrative had restored state’s possession of IDR 1.364.276.160.371,93 (One Trillion Three Hundred Sixty Four Billion Two Hundred Seventy Six Million One Hundred Sixty Thousand And Three Hundred Seventy One Indonesian Rupiah And Ninety Three Cents) and land measured + 13.250 m2. Referring to to the bureaucratic reform program, Attorney Service internal management by the use of balance score card theory had resulted in the following achievements of: 1. Stakeholders Aspect Among ministrial level institutions, Attorney Service achieved
5th place for The Most Transparent Public Information. However, although Attorney Service was positioned on the 5th place at the said level, Attorney Service achieved 1st place for The Most Transparent Public Information from all of the other existing national law enforcement institutions. The merit showed that Attorney Service had duly accepted transparency as an obligatory prerequisite for the accomplishment of a bureaucratic reform that is clean and devoid of corruption, collusion and nepotism (KKN). As the stakeholder, the constituent would certainly benefited from the easy access of observation on Attorney Service, particularly on the side of the performance and budget expenditure of the institution, as well as from the participation for positive intervention over policies to be officially validated by Attorney Service in the future. 2. Business Process Aspect Attorney Service had succeeded in straightening up the aspect of business process, particularly in the organizing of existing Standard Operational Procedure (SOP) so as to become more adequately by adding a number of Attorney General’s Regulation, Attorney General’s Circular Letters and Junior Attorney Generals’ Circular Letters addressed to all members of the corps of Attorney Service in every location in order to give each of the task force the instructions and directions on the manners to apply orderliness and good procedure in their daily assignment as suitable to each scope of work. Attorney General’s Regulation No.: PER-022/A/JA/3/2011 on The Coordination for The Supervision of Attorney Service. • R.I Attorney General’s Regulation No.: PER-026/A/JA/10/2013 dated October, 3rd, 2013 on The Treatment and Protection for Informant of Law Infringement in Attorney Service. • R.I Attorney General’s Circular Letter No.: B-012/A/CU.2/01/2013 dated January, 18th, 2013 on The Manual for Accounting Policies and Completion on State Owned Credit from Corruption Cases Retribution. • R.I Attorney General’s Circular Letter No.: SE-0006/A/JA/03/2013 dated March, 25th, 2013 on Inter Division Collaborative Model between Civil and State Administrative with Intelligence, General Crimes and Special Crimes; to evade the possibility of conflict of interest. • R.I Attorney General’s Circular Letter No.: SE-002/A/JA/10/2013 dated October, 30th, 2013 on Principle of Impartiality by means of consideration on the standards for a quick, straightforward and low-cost court administration to the quality of the case, and the protocol for coordination with The National Police Force. 3. Learning & Development Aspect Attorney Service had proclaimed Zone of Integrity towards Anti Corruption Area as the form of high commitment from Attorney Service in organizing the aspect of Attorney Service personnel integrity for the process of Attorney Service performance that is clean and devoid of corruption, collusion and nepotism (KKN). Subsequent to activities implemented during the

previous year for the improvement of the professionalism and competence of the Attorneys, in 2013 Attorney Service had performed three (3) times Assesment on Competence for the structural position of Echelon III, IV and Special Attorney for Corruption Cases, as conducted by a third party, to 6.324 participants with 39,64 % rate of passing, or equal to 2. 507 persons. 4. Financial Aspect Different from the importance of the financial aspect in profit oriented private sector that made it as the most important factor, the importance of financial aspect for Attorney Service as a public sector that had the objective of delivering quality service to the public is closely related to the effort in obtaining the state’s support for all of the performance of its program and activity as well as for the improvement of welfare for the personnel through the allocation of budget sector support in National Revenue and Expenditure Budget (APBN). This financial aspect was unquestionably affected by the level of trust from the government, People Representative Council (DPR) and the constituent on accountability of Attorney Service budget management and compliance of Attorney Service to the bureaucratic reform program as mandated by the government. Although it was proven by Audit Board (BPK) 2013 Report that Attorney Service had maintained accountable financial aspect as in the BPK 2012 Report of Unqualified Opinion With Clarifying Paragraph, Attorney Service itself deemed this accomplishment as insufficient and intends to conduct better organization for its financial management as proper to The National
Accounting Standard to achive better accountability that will erase the sentence of “With Clarifying Paragraph”, so as to reach the level of “Unqualified Opinion” as the final result of BPK assessment on Attorney Service financial report. Other than the accomplishment in restoring the loss of the state’s finance or possession either by way of criminal or civil lawsuit as previously described, in 2013 Attorney Service had recorded another over target achievement of 483,82 % in Non-Tax State Revenue (PNBP) of IDR 527.702.962.013 from the targeted IDR 109.069.182.094. The recorded noteworthy achievements from both the side of law enforcement and improvement of quality
through bureaucratic reform program were not regarded as sufficient by Attorney Service that will make further endeavour on the management for professional improvement in its human resource, establishment of a more orderly and free from KKN Attorney Service bureaucratic environment, optimal implementation of a bureaucratic reform program as proper to the process of planning, Attorney Service budgeting that had particular aim to structural development, management of Attorney Service human resource, and better institutional transparency and accountability from both sides of Attorney Service duties performance and financial management.

T
he Attorney General Office is the government institution that exercises the state prosecutorial power. As an institution operates in the fields of law enforcement and justice, the Attorney General Office is headed by the Attorney General, who is appointed and removed by, and is directly accountable to the President. The Attorney General’s Office, Provincial Attorney’s Offices, District Attorney’s Offices and Branch Attorney Offices are all forming the state prosecutorial power. All compose an integral and inseparable entity.
2.1. ATTORNEY GENERAL OFFICE PROFILE The 1945 National Constitution mandated the law enforcers to stipulate equality in justice and government, 8

indicated that justice in the era of globalization shall be the ground for every governing acts to ensure the sense of justice and reasurre the presence of a just law to all the subjects. To create such conditions, the state law enforcers as the forefront officials must have an independent manner in performing their duties, irrespective to the differences within the social structure and classes existed in the general public that may influence the service. This demanded jurisdiction rationale in the form of implementation of law to assure the comprehensiveness on rights and obligations, and existence of social boundaries to freedom of every individual in doing the activities.
Under Legislation No. 16/2004, which superseded Law Number Number 5/1991 on the RI Attorney Service, the R.I Attorney Service, as one of the law enforcement institutions, required to deliver higher function in upholding legal supremacy, protection of public interest, upholding of human rights and eradication of corruption, collusion and nepotism. Under the preceding 2004 legislation, the RI Attorney Service, as the government institution responsible for exercising the power of the state in the prosecutorial field, must perform its duties in an independent manner, free from the influence of government or third parties (Legislation No. 16/2004 article 2 section 2).

Legislation No. 16/ 2004 on R.I Attorney Service also stipulates the central position of the Attorney Service in the strategic role to maintain resilience of the nation, due to the responsibility held by the Attorney Service in investigating and prosecuting certain types of cases, and its intermediary position to filter the processes of investigation and trial, as well as ensuring the implementation of final and conclusive effect of judicial orders and decisions, hence the Attorney Service holds the control for the judicial process of a case (Dominus Litis) since the institution determines the prerequisitions to proceed any judicial actions for a case or not, based on admissible evidence, as defined by the Criminal Procedures Code.
In performing its duties and powers, the Attorney Service is led by the Attorney General with the assistance of one Deputy Attorney General and a number of Junior Attorneys General and the Head of the Education and Training
It should also be noted that the Attorney Service is the only state organization responsible for the implementation of judicial decisions (executive ambtenaar). Besides its role in criminal cases, the Attorney Service also

plays other roles in the sector of civil and administrative by acting as the state’s attorney on behalf of the government in issues on law enforcement, legal aid, legal advice, and other legal actions to the state or government, encompassing the institutions/agencies, central and local government institutions/agencies, and central and local government enterprises, for the safeguarding and recovering of state assets, and providing legal services to the public. In the part as the holder of those powers, Attorneys have the right to bring public prosecutions, implement judicial decisions, and conduct other powers as conferred by the Legislation No. 16/2004 articles 30, 31, 32, 33 and 34 on R.I Attorney Service. The reform of Attorney Service organization and human resources is obligatory to adjust with the changing era, for irrespective to its extend and breadth, an organization would be rendered irrelevant should it fails to adjust to the change of times. This applies to the Attorney Service that consecutively conducting the comprehensive reform process in prosecutorial area, as implied by Legislation No. 16/2004 on R.I Attorney Service. To implement the actions for the efforts in improving its performance as implied in the Legislation No. 16/2004 on the R.I Attorney Service, the Attorney Service has made considerable reforms based on the six Attorney General’s Regulation issued on 21 July 2007 that covers the following organizational aspects: (1) Recruitment of Civil Servants and Candidate Prosecutors; (2) Career Development; (3) Education and Training Bureau; (4) Minimum Professional Standards for Attorneys; (5)

Code of Conduct; and (6) Supervisory Mechanisms. In performing its duties and powers, the Attorney Service is not only focused on handling of general crimes, but also corruption crimes, civil and administrative, as well as public complaints. The performance of these prime duties and functions is always based on the principle of equality before the law, without any distinction between individuals in regards to social status, ethnic group, religion nor race. Referring to the said six Attorney General’s Regulations, the Prosecution Service is fully aware that the success performance of duties requires collaboration and coordination with other existing law enforcement and judicial institutions. The 2012 Attorney Service Performance Development Agenda focused on bureaucratic reform through duties performance based on appropriate, well-designed, focused, effective and efficient standard operating procedures (SOP) to optimalize public services; conducted organizational reforms and formed professional, reliable, and accountable personnel to ensure proper duties performance as part of equitable and effective law enforcement process. The Attorney Service has the mandatory powers implicated in the Law to perform duties by conducting effective, appropriate, and costefficient monitoring and evaluation on administrative management and case disposal. Clean and upright case disposal will be potential to bring a good governance willed performance and handling of public impairing corruption cases that is expected to not only
convict of suspect, but also to ensure the significant recovery of state assets. To improve accountability, efficiency and effectiveness of systematic performance based on the pattern of good governance to prevent interference of cases as required in the application of good governance, the Attorney Service conducts direct connected supervision in collaboration with the public for followup actions on appropriate complaints, for optimum manners in handling and completion of cases and prevention on abuses of powers and ranks.
2.2. ORGANIZATIONAL STRUCTURE With the Presidential Regulation No. 38/2010 on R.I Attorney Services Organization and Management, the Attorney Service has been performing its duties in referrence to the virtue of Attorney General’s Regulation No. 009/A/JA/01/2011 on the Organization
and Work Procedures of the Republic of Indonesia Prosecution Service that has reformed organizational structure The Attorney General is the leader and highest office holder in the Prosecution Service, and is responsible for directing and controlling the implementation of the duties and powers of the Attorney Service. In the implementation of his duties and authority, the Attorney General is assisted by one Deputy Attorney General, a number of Junior Attorney Generals, and one Head of Bureau. The Junior Attorney Generals are as follows: (1) Junior Attorney General Development; (2) Junior Attorney General Intelligence; (3) Junior Attorney General General Crimes, (4) Junior Attorney General Special Crimes, (5) Junior Attorney General Civil and Administrative; (6) Junior Attorney General Supervision; and (7) Head of the Education and Training Bureau.

The Deputy Attorney General has the duties and powers to assist the Attorney General in the implementation of his duties and to represent the Attorney General should the Attorney General be unavailable of service, as well as such other duties as assigned by the Attorney General. The Junior Attorney General Development has the duties to conduct planning, infrastructure and facilities development, organizational and administrative procedures, human resources and financial administration, management of state assets, provision of legal opinions, preparation of legislation and regulations, overseas collaboration engagement, and provision of other technical services and support. The Junior Attorney General Intelligence has investigative, security and support duties concerned with the prevention of crime so as to support law enforcement of a preventive or coercive nature in the areas of ideology, politics, economics, finance, socio-cultural, defense and security; imposing travel bans, and helping to uphold public order and security. The Junior Attorney General General Crimes has the duties and powers in the management of general crimes encompassing pre-prosecution, additional investigation, prosecution, appeal, and enforcement of judicial orders and decisions of final and conclusive effect; examination and supervision of of those serving conditional sentence, placed under supervision orders, or released on parole, and other legal actions. The Junior Attorney General Special Crimes has the duties and powers in the management of general crimes

that are governed by special criminal procedures encompassing investigation, examination, pre-prosecution, additional investigation, prosecution, appeal, and enforcement of judicial orders and decisions of final and conclusive effect; examination and supervision of of those serving conditional sentence, placed under supervision orders, or released on parole, and other legal actions. The Junior Attorney General Civil and Administrative has the duties and powers in the management of civil, and state administrative and constitutional cases encompassing law enforcement, state attorneys, provision of legal advice and other legal actions to the state and government including state institutions/ agencies, central and local government institutions/agencies, and state and regionally owned enterprises, in order to the safeguarding and recovery of state assets, preservation of government authority, and provision of legal services to the public. The Junior Attorney General Supervision has the duties and powers in the management of of effective internal supervision through planning, implementation and controlling the implementation of Attorney Service internal performance and financial supervision, and implement supervision on particular purposes as assigned by the Attorney General in accordance to the laws and regulations in effect. The Education and Training Bureau has the duties and powers in the provision of education and training within the context of strengthen and development of Attorney Service personnel competencies and professionalism.

T
o improve the civil servant level of professionalism, the government had announced the obligatory Bureaucratic Reform Program to be implemented by all personnel within the Ministrial/National Institutions level and all of the civil servants throughout Indonesia for Good Governance. The Bureaucratic Reform Program is one of the eleven priorities of national development. Attorney Service had been implementing Bureaucratic Reform Program in different phases since 2008. In 2009, Attorney Service submitted its report on the implementation of phase I of the program to the Minister of Administrative Affairs and Bureaucratic Reform, who then assigned an independent committee to evaluate the report. At the end

of 2009, the Independent Team reported that the bureaucratic reform program was being successfully implemented by the Attorney Service, that was followed by the award of incentives to the personnel within Attorney Service as a part of bureaucratic reform implementation. In general, Bureaucratic Reform Program in Attorney Service was aimed to develop the profile and professional attitude which had the integrity, high level of productivity, responsibility and giving priority of optimal service to the public. The main particular objectives for Bureaucratic Reform Program in Attorney Service encompassed: First, to create Attorney Service as a right size organization that had definite function, Second, to form a high performance and
professional Attorney Service bureaucracy, Third, to develop a comprehensible, effective, efficient and measurable working system, process and procedure as proper to the standard of good governance, Fourth, to create Attorney Service bureaucracy that implemented regulation and deregulation in a proper, orderly and conducive manner, Fifth, to form reliable, competent, professional, high performed, secure, and decent Attorney Service human resource. In 2010, Ministry of Administrative Affairs and Bureaucratic Reform issued a new bureaucratic reform implementation guideline for all ministries and/or institutions. Attorney Service adjusted its bureaucratic reform implementation with the new guideline. Based on the Grand Design and Road Map for Bureaucratic Reform 2010 – 2014 (Presidential Regulation No. 81/2010 and Minister of Administrative Affairs and Bureaucratic Reform Regulation No. 20/ 2010), every ministries and/or institutions had to implement the reform in 8 areas of: 1

To further define the 8 Reform Areas, every ministries and/or institutions had to implement almost 40 programs to accomplish 23 performance indicators. Some implementation of Bureaucratic
Reform Program in Attorney Service until 2013 were: REFORM AREA I (Management) : Implemented programs were: a) Established Attorney Service Bureaucratic Reform Directive Team 2013 by R.I Attorney General Directive No.: KEP-011/A/JA/01/2013 dated th January, 28 , 2013 and Establishment of Attorney Service Reform Management Team by R.I Attorney General Directive No.: KEP-1-001/A/JA/01/2013 dated January, 31st, 2013 to improve participation in act of reform; b) Conducted joint meeting between Directive Team and R.I Attorney Service Reform Management Team led by Deputy of Attorney General as the Head of Directive Team, that was followed by a meeting between the Head of Planning Bureau Reform Management Team; c) Conducted Monitoring and Evaluation activity for the implementation of Bureaucratic Reform by the Directive Team and Management Team that encompassed 8 Reform Areas in 5 Provincial Attorney Offices of: West Java Provincial Attorney Office, North Sumatera Provincial Attorney Office, Bengkulu Provincial Attorney Office, East Kalimantan Provincial Attorney Office and Bali Provincial Attorney Office participated by each Head of Provincial Attorney Office, the Deputy of Head of Provincial Attorney Office, Asistants, Coordinators, the Head of the District Attorney Offices, the Head of the Branch Attorney Offices, the Heads of Intelligence Sector Sub Division, the Heads of Sections and servicing Attorneys; d) Conducted Envisioning Workshop for Attorney Service Leaders from Echelon I and II to improve commitment on reform and behavioural change;

e) Revised the 2007 Attorney Code of Conduct in 2012 in order to make it more relevant to the international standard for the drafting of Reform Management Strategy, particularly for ones related to Personnel Code of Conduct. Formed R.I Attorney Service Workload Analysis and Evaluation on Profession Team in 2013 as stipulated in R.I Attorney General Directive No.: KEP-034/A/ JA/03/2013 dated March, 6th, 2013 to had specific division of tasks and functions for each of the position in Attorney Service, and conducted analysis on workload and evaluation on position to do inquiry on the numbers of Attorney required in each office or task forces throughout Indonesia. Currently, Attorney Service had done analysis on workload and evaluation on position in two Provincial Attorney Offices of Nusa Tenggara Timur Provincial Attorney Office and Papua Provincial Attorney Office, as well as in two District Attorney Offices of Kupang District Attorney Office and Sorong District Attorney Office;

Conducted study on right-sizing for the purpose of implementation of Attorney Office organizational rightsizing, as is to be regulated in new R.I Attorney General Directive on Attorney Service Organization and Management that enabled annulment of 3.000 (three thousands) positions; 3. c) Development of key performance indicators (KPI) for IT based task forces; d) Developed Attorney Service Communication Strategy for Education and Anti Corruption Organizational Culture for area of communication strategy for education and anti corruption organizational culture (Strakom PBAK) at Equipment Bureau. REFORM AREA V (Human Resources Management) Implemented programs were: a) Conduction Selection Program Candidates for Participants in Prosecutorial Education and Training (PPPJ) in January 2013 to improve Attorney Service Human Resources Management. REFORM AREA VIII (Public Service Development) Implemented programs were: Development of Attorney Service Standard Public Service Regulations (SPP). Furthermore, as an supportive effort to each Attorney Service task force to improve the public service, a team from Attorney Service had assisted assessment on Prime Service (CPP) visit from Ministry of of Administrative Affairs and Bureaucratic Reform Public Service Assessor Team to 3 (three) District Attorney Offices of: Denpasar District Attorney Office, Tabanan District Attorney Office and Singaparna District Attorney Office, as well as Centreized assessment done within the Attorney General unit and Centre for Legal Information and Outreach (Puspenkum) working unit. REFORM AREA VIII (Monitoring and Evaluation) Attorney Service had designed the model and mechanism for the implementation of monitoring and evaluation for proper implementation of Bureaucratic Reform Program in accord to Bureaucratic Reform Self Assessment guideline as stipulated in the Minister of Administrative Affairs and Bureaucratic Reform Regulation No. 31/2012 on Guideline for Bureaucratic Reform Self Assessment (PMPRB), and as a realization of the action plan, Attorney Service had disseminated related information and conducted the filing of PMPRB working papers at 25 (twenty five) Provincial Attorney Offices in Indonesia. ATTORNEY SERVICE BUREAUCRATIC REFORM PROGRAM IMPLEMENTATION MANAGEMENT The Attorney Service initiated the implementation of Bureaucratic Reform Program by employing the structure of Attorney Service Bureaucratic Reform
Program Team. From the phase of program planning the establishment of technical team to implement a certain program was done simultaneously with the implementation. With adequate level of participation the Attorney Service had implemented most of the mandatory programs as stipulated in Minister of Administrative Affairs and
Bureaucratic Reform Regulations. For acceleration of R.I Attorney Service Bureaucratic Reform Program some priority programs strategic activities will be implemented as a part of institutional improvement, that is to be showed in the following Institutional Strategic Map:

A
lthough the division of Development had no direct contact with the operation of R.I Attorney Service main duties and function which are associated with cases handling management, nevertheless this division had a strategic supportive role to the performance of duties and function of other divisions. To enhance the role of Devlopment division in supporting the performance of other divisions in particular relation to the effort of law enforcement, in 2013 R.I Attorney Service had confirmed the focus for organizing the division of Development that comprised of: provision of reliable Attorney Service personnel, establishment of merit system based Human Resources Development Management, employment

of IT in the strategy of development and distribution of human resources, good management in finance and State’s Owned Properties, performing arrangement in R.I Attorney Service organizational structure and management as proper to the analysis on workload and position in an effective and efficient manner, increased legal sector collaboration specifically Mutual Legal Assistance (MLA), and adequate provision of proper facilities and infrastructures. On empirical level, in 2013 the Attorney Service had implemented a series of activities of: 1. Organizational Structure and Management a. Established new District Attorney Offices of Tebing Tinggi District
Attorney Office, Lima Puluh District Attorney Office and Boroko District Attorney Office in 2013 based on R.I Attorney General Directive No.: KEP088/A/JA/6/2013 on Organization and Management of Tebing Tinggi District Attorney Office, Lima Puluh District Attorney Office and Boroko District Attorney Office. b. Initiation and establishment of Attorney Service Medical and Forensic Integrated Service Unit (UPT), or known as Adhyaksa Hospital located in Ceger, East Jakarta, Jakarta that was planned to be in fully operation in 2014 as stipulated in R.I Attorney General Regulation No.: Per-20/A/ JA/8/2013 dated August, 14th, 2013 on Organization and Management of Health Service Unit.
The establishment of the health facilities was done in collaboration with Ministry of Health and Jakarta Provincial Health Office with the
objective of supporting the hastening of case handling of medical and/ or forensic based corruption and/or general crime cases. 2. Finance a. Budget Disbursement
2013 2012 R.I Attorney Office Budget Allocation Requisitions (DIPA) valued at IDR 4.347.164.974.000,- (Four Trillion Three Hundred Forty Seven Billion One Hundred Sixty Four Million Nine Hundred Seventy Four Thousand Rupiah), with actual disbursement from the overall R.I Attorney Office work forces dated December 31st, 2013 of IDR 3.835.224.105.476,- (Three Trillion Eight Hundred Thirty Five Billion Two Hundred Twenty Four Million One Hundred Five Thousand Four Hundred Seventy Six Rupiah) or equivalent to 88%.

Conducted selection for candidates participants in the Attorney Training 2013 with the objective to gather 450 candidates participants in the Attorney Training 2013. d. Conducted the following third party directed Competence Asessments of : - Competence Assessment for structural positions in Echelon III, IV and Specialist Attorneys for Special Crimes participated by 4.115 persons. - Competence Assessment for positions in Echelon III year II participated by 754 persons. - Competence Assessment for structural positions in Echelon IV and Specialist Attorneys for

4.2 INTELLIGENCE One of R.I Attorney Service main duties and functions as stipulated in Legislation No. 16/2004 is to safeguard stabilization and public order through a series of activity to raise public awareness, safety measurement for policies of law
enforcement, safety measurement on printed materials, supervision on religious and beliefs movements, and prevention of abuse and/or denigration of religion as conducted by Intelligence division. Other duties of Intelligence division were to support duties and performances of General Crimes, Special

Crimes, and Civil and State Administrative. R.I Attornes Service Intelligence Division led by Junior Attorney General Intelligence assisted by one Secretary to Junior Attorney General Intelligence dan three Directorates for Technical Issues, Coordinator, and Taskforce Unit, and each regional Head of Intelligence Work Force (in Provincial, District, and Branch Attorney Offices). Technical issues in law enforcement managed by R.I Attorney Service Intelligence Division encompassed: 1. Safeguarding and restoration of state assets and economy, and supporting the performance of General Crimes Division. 2. Prevention, supervision of mass media, printed materials, foreigners, supervision of religious and beliefs movements that included sects, cultural beliefs, religious and cultural mysticisms, occultism, traditional metaphysic healing, clairvoyance, acupuncture, traditional healing practice, metaphysic, and other relevant subject that could endanger public and state, prevention of abuse and/ or denigration of religion, ideology, politic, social, culture, defense and security, state unity, violation on human rights, pursuit and arrest of Attorney Service fugitive, as well as supporting the performances of Development and Supervision Divisions, and other duties as instructed by Junior Attorney General Intelligence. 3. Cryptology, administration and products of Intelligence Division. 2013 performance of Intelligence division were: a. In 2013, the Secretary to Junior Attorney General Intelligence had conducted - Optimal secretariat services for the targeted 12 months of service that

enabled timely accomplishment and administrative and financial orderliness of all of the main duties and function for investigation (LID), confinement (PAM) and supportive (GAL) programs on intelligence cases in each Directorate and Centre for Legal Information and Outreach. - 100% achievement of 31 (thirty one) activities on Supervision and Performance Evaluation, and Socialization of R.I Attorney General Regulation No.: PER046/A/JA/12/2011 dated December, 28th, 2011 on Integrated SOP for R.I Attorney Service internal affairs case management. - Grading on Intelligence Performance for all of Provincial Attorney Offices in Indonesia. b. In 2013 Directorate I had performed: - 82% achievement of 82 activity reports (LHKs) from the targeted 100 LHKs from Intelligence Operation in the sector of Economics, Finance and Development. - 84% achievement of 42 activity reports (LHKs) from the targeted 50 LHKs from Intelligence Operation in the sector of Economics, Finance and Development. - 88,7% achievement of 71 activities from the targeted 80 activities in Asset Tracing for execution of restitution to R.I Attorney General Office. c. In 2013 Directorate II had performed: - 100% achievement of 50 LHKs in the sector of Politics, Socio Cultural and Organizational Resources within R.I Attorney General Office. - 100% achievement of 4 LHKs for Intelligence Operation in the sector of Supervision on Religious and
Beliefs Movements in Communities. d. In 2013 Directorate III had performed: - 100% achievement of 50 LHKs from the sector of Intelligence Facilities and Products. - 100% achievement of 65 persons/ Supportive Activities for Confinement of R.I Attorney Service Fugitive. e. In 2013 Centre for Legal Information and Outreach had performed: - 100% achievement of completion of 4 activities in Legal Information and Outreach. - Most favourable completion of activities in Media/Facilities for Legal Outreach and Dissemination of Information.
f. In 2013, Intelligence division and sections in Provincial Attorney Offices and District Attorney Offices in Indonesia had performed: - 100% achievement of 632 activity reports from Anti KKN networking activities in Provincial Attorney Offices and District Attorney Offices. - 104,2% achievement of completion of Legal Information in 633 Provincial Attorney Offices and District Attorney Offices from the targeted 608. - 93,3% achievement of Legal Outreach in 362 communities in Provincial Attorney Offices and District Attorney Offices from the targeted 388.

4.3 GENERAL CRIMES To perform General Crimes case management, R.I Attorney Service carried out a series of tasks of: pre-prosecution, additional investigation, prosecution, legal actions, enforcement of judicial order dan decisions of final and conclusive effect, examination and supervision to those serving conditional sentence, placed under supervisory orders, released on parole and other legal decisions as stipulated in Legislation, for example to conduct diversion to achieve restorative justice as mandatory additional duties on R.I Attorney Service upon the validation of Legislation No. 11/2012 dated July, 30th, 2012 on Court System for Child Crimes. Related to target performance and government budget allocation, the handling of General Crimes does not belong into category of national priority, therefore this division has neither government mandated specific target nor level of priority within government budget allocation. In spite of exclusion of General Crimes from priority, its nature which provides sense of justice as demanded by the justice enquiring public makes the handling of General Crimes cases to have significant importances in achievement of Attorney Service mission of recovering public trust.

On the said rationale, in handling of General Crimes cases, the Attorney Service fastened itself to professionalism principles derived from obedience to every in-effect stipulations within legal regulations and put its conscience forward to comply with the sense of justice. Improvement of General Crimes has been done through: (1) a faster, more effective, more efficient, and more controlled case disposal in a professional and proportional manner, (2) ensuring balance in number of cases received and disposal subsequent to result of a more straightforward process of examination, (3) guidelines (criteria) for prosecution of General Crimes to increase the level of public contentment for the sense of justice, (4) delegation of power for important cases prosecution plan, (5) minimize backwards and forwards sending of cases, and backlogs of case investigation commencement warrants (SPDP) and investigation result completion confirmations (P-21). 4.4 SPECIAL CRIMES Anti corruption is one of the government defined priorities within the sector of politics, law and order. To carry on the duties, Attorney Service entrusted the said responsibility to the division of Special Crimes that does not restricted to the corruption case management only but also in managing the cases of other Special Crimes (i.e.: Money Laundering, Exclusive Economy Zone [ZEE], Fishery, Customs and Excise). For the handling of corruption cases that was defined as a national priority, R.I Attorney Service had done a series of organization for both sides of policy and practice of anti corruption law enforcement implementation. On the side of policy, since 2013 R.I Attorney Service has established target on quality of Corruption Crimes case handling management, mapping on corruption vulnerable government sectors, and created a number of practical guidelines and manuals to ease on site implementation of technical duties. On the practical side, R.I Attorney Service has attempted to provide the budget requirement for corruption cases handling management that was based on actual cost system. R.I Attorney Service is fully aware of the fact that quantitative aspect could not be the sole target indicator for the capitalization on performance of Special Crimes division, hence R.I Attorney Service put on the condition of quality improvement for the corruption cases
handling management, from the phase of investigation, examination, prosecution up to execution, to give the effort of eradication of corruption not only the inclination in number of case but also the recognition on the quality of the handling process as well as of the type of the case being handled, both from the aspects of technical, intellectual level of the perpetrator, modus operandi, impact and the loss suffered by state financial. The current trend in the effort of eradication of corruption is not only to perform legal action to the perpetrators, but also must be able to restore the loss suffered by state financial. Therefore, it was expected that the investigators and examinators have the capabilities to trace the wealth and asset of the perpetrators as well as conducting the seize to be put as the evidence to be considered for restitutional charge. The leaders on the central level have employed steps of improvement in terms of delegation of power to the Heads of Provincial Attorney Offices and Heads of District Attorney Offices as the regional leaders for taking the rein in handling of corruption cases, with the objective to gain faster pace in handling of corruption case by means of cutting the long bureaucratic line without neglecting the values from local wisdom and put conscience forward by means of delivering proper report of the implementation to the higher leaders.

Throughout 2013, Special Crimes division (at the level of R.I Attorney General Office, Provincial Attorney Offices, District Attorney Offices and Branch Attorney Offices) has investigated 1.709 cases, examined 1.653 cases, prosecuted 2.023 cases, and restoring IDR 403.102.000.215,- (Four
Hundred Three Billion One Hundred Two Million Two Hundred Fifteen Rupiah) and USD $ 500.000,00 (Five Hundred Thousand US Dollar). The following graphics showed the performance of case handling:

By persuasive means, the execution of convicted Gen.Com Pol. (Ret) Drs. SUSNO DUADJI, BA. MA. M.Sc. was accomplished on May, 2nd, 2013 at 23.10 WIB in Class II Cibinong penitentiary.
2. Execution of R.I Supreme Court Verdict No.: 161K/Pid.sus/2012 dated April, 10th, 2012 on convicted THEDDY TENGKO.

By coordination with Danrem 151 Binaiya Kodam XVI Pettimura, on May, 29th, 2013 at 14.25 WIT, Executor Team succeeded in the arrest of the convict THEDDY TENGKO at Rar Gwarmar airport, Dobo, to be executed in Ambon penitentiary.
4.5 CIVIL AND ADMINISTRATIVE
STATE
As stipulated in Legislation No. 16/2004 on R.I Attorney Service, besides the power of criminal case handling, R.I Attorney Service was also has the power to conduct law enforcement on State Civil and State Administrative Affairs. To perform the main duties and functions of the power, R.I Attorney Service Civil and State Administrative Affairs arranged three structures of directorates, each led by Director of Civil, Director of State Administrative, and Director of Restoration and Protection on Rights. Each Directorate divided the power into five sections of: (1) Law Enforcement, (2) Legal Assistance (State Advocation), (3) Legal Opinion, (4) Law Service, and (5) Other Legal Actions. 2013 achievement of Civil and State Administrative Affairs were: a. Duties and power of Civil and State Administrative Affairs. 1) Law Enforcement
No case registered throughout 2013. Activity of Law Enforcement here is limited to Attorney Service effort in completion of restitution paid by corruption convicts under Law No. 3/1971.
2) State Advocacy
In 2013, State Advocacy by State Attorney representing the government at national and regional levels (by litigation) reached 2.961 cases (by litigation).
In 2013, Legal Opinion activity reached 468 dossiers comprised of the activity of delivering Legal Opinion and implementation of Legal Assistance.
4) Legal Service
In 2013 Legal Service activity reached 358 cases.
5) Other Legal Actions
In 2013, activity in Other Legal Actions (particularly as mediator) reached 2 cases.
b. Recovery and Restoration of State Funds. 1) In 2013 at central level (R.I Attorney General Office) recovered State Funds was amounted to IDR 32.742.960.000,00,- (Thirty Two Billion Seven Hundred Forty Two Million Nine Hundred Sixty Thousand Rupiah) whereas restoration of State Funds was amounted to IDR 85.904.081.238,00,(Eighty Five Billion Nine Hundred Four Million Eighty One Thousand Two Hundred Thirty Eight Rupiah). 2) In 2013, State Funds recovered at the level of Provincial and District Attorney Offices throughout Indonesia amounted to IDR 1.182.794.121.105,90 (One Trillion One Hundred Eighty Two Billion Seven Hundred Ninety Four Million One Hundred Twenty One Thousand One Hundred Five Rupiah And Ninety Cents) and land of ±13.250 M2. integrity with accountable performance of the institution are crucial elements for the successful performance of the institution.
Complain Reports in 2013
In accord to the importance of enhancement for supervisory role particularly in the sector of law and personnel, R.I Attorney Service had established the practical attempt to enhance supervisory role within the scale of priority. Management and completion of complaints reports in Junior Attorney General Supervision was managed by 5 (five) Inspectors of: (a) Inspector I, (b) Inspector II, (c), Inspector III, (d) Inspector IV, (e) Inspector V. 760 complaints reports was received in 2013 that was added with 413 remaining ones from 2012, making the total sum of 1.173 complaints reports. As a follow up, at the end of 2013, 778 complaints reports were completed, with 109 complaints reports were declared “verified” whereas 669 were declared “unverified” that made 33,67% rate of reports completion.

a. News reported on electronic media SINDONEWS.com with the headline of Jakarta Provincial Attorney Office rebutted the allegation of bribery in the handling of PT. Master Steel tax crime case.
Upon the news coverage, Junior Attorney General Supervision
conducted the attempt of clarification as stipulated in Junior Attorney General Supervision Order No.: Print-133/H/Hjw/07/2013 dated July, 19th, 2013, with the result that the news reported on electronic media SINDONEWS.com did not require to be follow up with inspection on case due to lack of preceding evidence for the presumption of indiscipline act that might alter should other data and new fact are found in the future.
Narcotics Owners”, which reported the improperly mild demand done by Attorney Diah Ayu, BA, at Jakarta Provincial Attorney Office to convicted SUNIL LAUNGANI and convicted Hardy Arga Ciputra a.k.a Kiting et.al in case handling of Narcotics and Psychotropics crime of possession of 598 ecstasy pills. Clarification to the news as stipulated in Junior Attorney General Supervision Order No.: PRIN--298/H/Hjw/08/2013 dated August, 16th, 2013, resulted in the conclusion that the news coverage did not require to be follow up with inspection on case due to lack of preceding evidence for the presumption of indiscipline act that might alter should other data and new fact are found in the future.
a. Indication of indisciplier act of refraining from submittal of appeal done by Attorneys at Jakarta Provincial Attorney Office and East Jakarta District Attorney Office in relation to the handling of PT. Genta tax crime case.
Related to this indication, an inspection to the case were carried out as stipulated in Junior Attorney General Supervision Order No.: Print-132/H/Hjw/07/2013 dated July, 19th, 2013. Result deduced from data and facts found during the inspection of the tax crime case involving PT. GENTA DUNIA JAYA RAYA revealed that Plaintiff/ Public Attorney ALBERTINUS P NAPITUPULU, BA.MA, et.al (Head of Legal Information and Outreach Section Jakarta Provincial Attorney Office) has been proven performing indiscipline act of unreliable, irregular, inaccurate and indifferent attitudes in working for the state interest as stipulated in Government Regulation No.: 53/2010 Article 3 Point 9.

Clarification through functional inspection to the case proved indiscipline act to Government Regulation No.: 53/2010 Article 3 point 6 that resulted in medium level of disciplinary sanction of 1 Rank Demotion for one year as stipulated in Government Regulation No.: 53/2010 Article 7 point 3.c.

To follow up on the drafting of Instrument for Unit of Performance Appraisal (IPKU), Junior Attorney General Supervision collaborated with R.I Attorney Service Reform Team and Consultant from Hay Group to refine the IPKU draft that has been reported to the R.I Attorney General; 3. Declaration
Numbers of Attorney Service personnel obliged to declare their assets were 11.421 persons, with compliance number for LHKPN Form A and Form B reached 2.472, or equal to 21,64% and outstanding LHKPN of 8.949, or equal to 78, 36%.
4.7 EDUCATION AND TRAINING One of the significant program done to improve the quality and capability of R.I Attorney Service human resorces is
Education and Training that has been effectively and efficiently managed. The effective and efficient management has been done since the identification on requirements of education and training, designing of materials, implementation, up to the evaluation on the implementation of the education and training program. As relevant to the attempts of supporting the improvement of professionalism and capabilities of R.I Attorney Service personnel, in 2013 the government has allocated budget for R.I Attorney Service education and training of IDR 130.469.838.000 (One hundred thirty billion four hundred sixty nine million eight hundred thirty eight thousand rupiah), and has included 13 activities as mandated priorities within R.I Attorney Service management and leadership educational program to ensure the success of bureaucratic reform program. Program Performance of R.I Attorney Service Bureau of Education and Training was establishment in 2013 which is a part of R.I Attorney Service 2010 – 2014 Strategic Plan (Renstra). The said program was Technical Functional Education and Training Program, Management and Leadership Education and Training Program and Other Technical Management Support Program of

o implement Bureaucrati Reform towards Good Governance 2025 Attorney Service performance in 2013, E-Procurement (LPSE) LPSE has become a part of Bureaucratic Reform done in the line of management of procurement for goods and service. R.I Attorney Service LPSE performed electronical procurement for goods and service required by the institution that was developed to modify performance of procurement duties into a better, effective and efficient service system. E-Procurement or internet based online procurement of goods and service is an attempt to ensure transparent bureaucracy, minimalize misappropriation and shortening the long bureaucratic line that has been operated in R.I Attorney Service since 2011 through MoU between R.I Attorney Service 72

and Ministry of Finance LPSE. Procurement Service Unit (ULP) in R.I Attorney Service was established to create a professional procurement process that is free from intervention, corruption, collusion and nepotism, with the objective of developing a system that is able to minimize possibility of error of misappropriation in procuring goods and service, and to procure economical quality goods and services through effective and efficient means, and fair and transparent competition. Procurement activity for R.I Attorney Service in 2013 has temporarily undergone the LPSE system under Ministry of Finance. Currently R.I Attorney Service has been preparing the development of LPSE Mandiri and would implement its own ULP in 2014.

T
he people of Indonesia in this time has gained better awareness of their constituency rights and obligations. The dynamic population demanded the aspects of convenience and promptness in administrative service. In accordance to the meet the public demands on information, R.I Attorney Service convey the 2013 Annual Report as the manifestation of R.I Attorney General 2013 Performance in delivering the best service to the justice enquiring public. R.I Attorney Service realized that despite many reforms for improvement of the institution, the public still required a series of overall changes in particular regards to

those related aspects of management, human resources in R.I Attorney Service and the organizations as well as quality improvement and acceleration of R.I Attorney Service performance in the service of legal assurance and sense of justice to the public, which would directly benefit the public in terms of correlation between legal assurance with improvement of people’s social well-being. Upon consideration over the response from the community, it was deemed necessary to do another series of arrangement actions within R.I Attorney Service in the future that will straighten R.I Attorney Service internal supervision system to enable preventive aspect and ensure objectivity
in the system of reward and punishment for Attorney Service personnel, organize personnel integrity aspect, improve human resources developmental effort by means of merit system, manage performance based budgeting system and maximize budget disbursement by complying to determined outputs, upgrade of means for and/or progress the operation of information technology for performing the duties of R.I Attorney Service, and last but not least, improve the well-being of adhyaksa personnel. In the attempt of doing a simultaneous and sustainable reform into a structure
within an institution, legal customs and the substance of performance, every phase of improvement needs to be done accordingly to the plan that must be measurable in a clear design as proper to the public expectation. To conclude this report, improved performance and maintained personnel integrity of R.I Attorney Service were expected to bring greater public trust for the institution and to enable R.I Attorney Service in keeping with the progress and changes of times to attain an Affluent, Just and Democratic Indonesia.
